Mentally Ill

Oftentimes convicted murders are exempt from standard sentences, due to mental illness. Do you think they should be held responsible for their actions?

Horrific acts of violence are sometimes comitted by someone 'not in their right mind.' How do you define 'right mind?'

Good question.

You see, that's where the lawyers come in.

The thing is, when looking at pleas like mental illness or insanity, and determining guilt or sentencing as such, the courts aren't really consistent about whether the intent (should guilt be found) is to punish or rehabilitate... and whether or not the defendant is "deserving" of either.

Seriously though, it's up to the Judge and jury to decide if the convict is insane or not. Or just confused... or summat.

Well, hullo everyone. As you can see, I don't hang out here muchly anymore. There's a good reason for this. Y'see, I've been hanging out at a different chatboard called Cardboardia. So far, I've been havin' a blast. Not that I don't love the TLA, but the magic of Entmoot is lost on me. So, as soon as TLA ends, so will my existance here, probably.

Who knows though? I might stay. Highly unlikely however. This is a good bye in advance, then. Unless you want to join me and my group of friends at Cardboardia.

What if the defendant was a mass-murderer. He pleas guilty, but is clearly mentally insane. Would you send him to a mental correction facility? Prison? Death penalty?

Or perhaps it would be best to let the victims' families select the method of punishment.

I think that anyone capable of actual murder is insane/suffering from extremes of emotion, and so they should not be able to get away with not going to jail on the basis that they are the same as any other killer.
Did that make sense?
